If he had died she may have used the word deceased or similar.
Tend to believe the 1871 census that she was still married and he had gone to America.

I think all the pieces are coming together, Just need to find John senior departing England for New York, leaving his wife, whi in the 1871 census, states she is married, but no husband to be seen. John Gilchrist junior is born in New York, in 1869. Leave England 1867 or 1868. Would he have to divorce his English wife, or what would the process be.

There was no mention of John Gilchrist senior in the 1862 court case, just his wife and son.

The early passenger lists sometimes do not have enough information to make a positive identification.
Ages may vary, occupations may not be mentioned.

There is quite an early passenger list for New York, U.S., Arriving Passenger and Crew Lists - arriving 9 th April 1861 on a ship named United Kingdom. John Gilchrist aged 33 years (born 1828) going to New York !!

New York Passenger Lists, 1820-1891

Sometimes people had not been divorced so he could be a bigamist !!

Strong possability that he could have been a bigamist. His wife Margaret, states in the 1871 census, that she was married, the children are there, but no husband. 1869 John's workshop, at Malt-Mill yard, Leeds, is up for rental. No marriage certificate in New York with the first child born there in1869.

Will I be able to obtain the death certificate of Thomas Gilchrist, born Huddersfield 1861 with burial in Leeds. What information would be on the certificate.
