Medals Forfeit?
« on: Saturday 25 May 24 21:08 BST (UK) »
Pte 3/10929 Mathew James Malone enlisted King's Liverpool Regt on 03/09/14 born September Quarter 1876 West Derby Liverpool Transferred to 13th King's on 01/10/1914 but Discharged 16/11/1914 under KRxi
There is an Attestation under Pension Records which shows he was in the Army Home and previously as Pte 5142 in 2nd Manchester Regt
This Attestation is noted at Discharge on 16 November 1914 that Medals are Forfeited.
What Medals and Why ?
If it refers to Punjab or Boer would he have to send them back?

This Attestation is noted at Discharge on 16 November 1914 that Medals are Forfeited.

Para 392 (xi) is being discharged for misconduct. So one assumes the misconduct led to the medals forfeiture. Have you checked his Medal Index Card and also the medal rolls? You might see "forfeited" noted there, as well.

Army Act
(Section 44 (xi)) and the Royal Warrant for Pay, etc. (Articles 637, 785 and 1236–1239). Orders and decorations are forfeited under the Royal Warrants governing the award. The Regulations clearly show a recipient that he is liable to be deprived of his medal or decoration if he misbehaves. With regard to the latter part of the hon. and gallant Member's question, it is considered undesirable that men convicted of serious criminal offences should continue to wear medals and decorations awarded for bravery seeing that they have by their conduct forfeited the honour and respect attached to holders of those honourable distinctions.

Several pages into his 1914 service record indicates:

"Medals forfeited under Article 1236 (b) of the Pay Warrant dis/e Misconduct"

See this link for more info:
https://www.grandadswar.org/tag/army-council-instruction-75-of-1921/

See the exception highlighted in red below --

"...the Army Council have decided that all D.C.Ms., M.Ms. and M.S.Ms. and war medals which, subsequent to 4th August, 1914, have been forfeited by a soldier under Article 1236 of the Pay Warrant as it stood before the present amendments were effected, shall be restored, except in those cases where the punishment of death by sentence of court martial or discharge under King’s Regulations, para. 392 (x) (on conviction by the Civil Power), (xi) (for misconduct), (xii) (on sentence of penal servitude), or (xiii) (with ignominy), has been carried out".

On his WW1 attestation he indicated that he had served with the Manchester Regiment with a service number of 5142. Find My Past have his service record under this number -- he attested on the 20th September 1895, aged 18 years 2 months. He declared that his occupation was that of a Boot Maker. He was placed into the 5th Battalion, Manchester Regiment. Page three of his record shows that he was entitled to South Africa Medals and Clasps -- snippet image courtesy of Find My Past.

It was his South Africa (Boer War) medals that he had to forfeit.

Had a Feeling it was possibly a Forfeit of Boer War Medals as non due WW1 which was puzzling regarding Medals Forfeited note.
