Hello- I have in my possession a court doc. granting my ggg grandmother Liston an annulment in 1866 - it states that she is presenting a "letter of divorce" - and the reason for her to ask for it was that her husband, who had been injured in 1861 - as a private in the armed service - had been absent for over 4 years.
The judge went on to grant her an annulment, and stated that she would revert to her maiden name, Tracy. I'm quite sure they were not Roman Catholic!
I can't understand why an annulment would have been granted instead of a divorce. There were 2 children involved.
