Hello,

Help needed on this one.

Is is possible that someone convicted of a crime in1823/4 could be given the option of joining the army rather than going to prison.

I have found a record in the York Assize Index for Jacob Hinchliffe committed on the 7th May 1823 aged 21 charged with rape.

On typing in Jacob's name on the National Archives website I got the following result:

Royal Hospital Chelsea: Soldiers Service Documents WO 97/363/122
JACOB HINCHLIFFE Born SILKSTONE, Yorkshire Served in 15th Foot Regiment Discharged aged 31 . JACOB HINCHLIFFE Born SILKSTONE, Yorkshire Served in 15th Foot Regiment Discharged aged 31 15th Foot: Eve - Hug
Date: 1824 - 1834

Could this be the same person who committed the above crime ?

Also where did the 15th Foot Regiment operate at this time ?

Any help appreciated

He wasn't convicted - he was found not guilty

The 15th Regiment were in Ireland from October 1822 to May 1827, when they sailed for Canada. They may have had a depot in Yorkshire or, as their nominal name was the Yorkshire East Riding Regiment, they may have sent recruiting parties back to Yorkshire. It was not uncommon for recruiting parties to be away for weeks or months, especially if recruits were in short supply. They returned from Canada in June 1840.

Even if he was found guilty I cannot see them waiting for more than seven months before ensuring he joined the army. It looks a good match. Maybe he thought it wise to leave the area.

Do you have any information about his wife and children, and where they were born?

Carole, I am trying to find out if he was charged with the crime, how do you know he was found not guilty ?

Ken, thanks for the info on 15th Foot, it was very interesting.
 
I am trying to find information on  Mary Hinchliffe bn abt 1825, census states born  Hoylandswaine which is in Silkstone Yorkshire.

Mary's marriage 1842 states father as Jacob a Weaver.

Found two bapt records at Cumberworth Yorkshire:
Possible this could be my Mary.

Ann dr Jacob & Sarah Cumberworth Weaver  2nd Sep 1823.
Mary dr  "            "      Hoylandswaine Soldier 9th Jan 1825

Found a marriage record at Silkstone 26 Dec 1822 Jacob Hinchliffe = Sarah Mellor.

On the rape charge it states that a James Mellor assisted the said Jacob Hinchliffe.

Not been able to find Mary Hinchliffe born abt 1825 in the 1841 census.

Any Ideas.

It says Not Guilty on the record - read over to the far right hand side of the entry
