GIVAN /S WALTER
« on: Thursday 23 August 12 08:01 BST (UK) »
Hello everyone.  I knew mygggrandfather Walter Givan (spelt variously Given/s ) was transported to Tasmania Australia in 1850.  According to records  his three brothers John Alexander and William were also transported.  They were all born in Kelso in around the 1820's.  Their parents are Andrew and Agnes and there was a sister Margaret.  None of this is confirmed so if possible could I please have a lookup to see if there is anything known of them or their parents.  Thank you very much.

Andrew GIVEN, birth c 1799, Scotland, Widower, Occp Carter, is in Berwick upon Tweed, Northumberland in 1861 Census.

No luck so far in finding them in 1851.

Lucky not being a Sotland Census I could actually look at this image;

1851 Census
Chapel Street,
Berwick upon Tweed, Northumberland
HO107/2421/520/50
Andrew GIVINS, 42 (image is 52), Head, Mar, Lab Quarry
Agnes Givins, 51, Wife, Mar
Andrew Givins, 18, Son, Unm, Labourer
Thomas Givins, 16, Son, Unm, Labourer
All born Scotland
+
David ROBERTSON, 3, Visitor, born Berwick

Someone named Deeess has corrected the name to Givens on this Census. They are in Australia.

Hi alexandramac

Not sure what papers you have got on Walter and his convictions. One main source for Scotland is the National Archives of Scotland. You can request an estimate for photocopying and this can be sent out by snail-mail.

There are two different trials showing there for 1847 and 1848, also the precognition (a Scots legal term: evidence put together before a trial, witness statements etc.) papers for I think the 1848 trial.

The precogonition papers show:

Walter Givan, son of Andrew Givan, carter or labourer, labourer, Address: Residing with father, Shaws Lane, Berwick on Tweed.

With all Trish's info above, this address looks a good match and puts the Givan family in Berwich on Tweed by at least 1847.

See here www.nas.gov.uk/onlineCatalogue/ Click on 'Search' at the top centre. Then 'Search for' box, input Walter Givan and click button for 'Phrase'. There only three entries showing there.

Busy family..... !

Using the same search screen, try the brothers' names....

For 1846 you have a precognition document:

Accused: Alexander Givan, son of Andrew Givan, labourer, Address: Church Street, Berwick-upon-Tweed, with father and John Givan, son of Andrew Givan, labourer, Address: Church Street, Berwick-upon-Tweed, with father.

A further entry there of the actual trial.

Alexander and John look to have been tranported after their trial in 1846?

Thank you so much Monical L and Trish1120..This name has been spelt so may different ways but DEVAN is a new one.  Walter's children are all reg under Gibbons, Gibbens, Givens, Givans etc as I saw on one of the original birth scans his wife could not read or write so would have all sounded the same to her hence the confusion a few generations later!  ( Not to mention her three husbands)There seems to be two convicts called John Givans, one born Kelso with no parents named and one Berwick on Tweed but has same parents as Walter and William recorded on Founders and Survivors so am wondering if he is one and the same and B O T is the trial place not birthplace  That is so much wonderful info on the family and so much more to go on now....I am thrilled..  Not sure who the Deese correctee is....
