John Day Wanganui

I have been tracing my Day family back to Wanganui but heres where it gets a little tricky and any input would be great.

John Day Married Eleanor Caroline Jervis in St Pauls Church Putiki Wanganui 12 Feb 1872, they had 5 children together all in Wanganui,  Eleanor died 11 Jan 1891 Aramoho Wanganui NZ.

I have their marriage cert and Eleanors death cert.  Neither  have very much information at all.

As far as I can tell living in Wanganui in 1872 there was only one family of Days, the father already having past away in 1860,  one of the sons was named John Day, but heres where it gets tricky and maybe a bit mixed up - John Day was married to a Mary Jane O'Reilly and they had 4 children, from what I have read in papers past, John as a drunk and would leave the family for weeks at a time.  A protection order was taken out by Mary Jane Day 22 March 1872 which was granted.

So I am wondering if this is the same John Day was he a bigamist or was there another John Day living in Wanganui from around or before Jan  1872 to at least 1891.
Any ideas?

Just at a glance of NZ records, can see this marriage.

John DAY - Mary Jane RILEY -- 1860

Possibly then the same lady you have as Mary Jane O'REILLY   ???

On the 1872 marriage certificate, does it gives John DAY's "condition" as a bachelor ?

yes it does,  and lists his job as a Labourer, but I was thinking if he was still married he wouldn't put that he was married also it lists his age as 24 the same as hers but I don't think that's right either, and other than their names, place of marriage and date that's all the information it has.

It does seem that the case between John DAY and Mary Jane DAY, continued beyond March 1872.

Can see that he makes another Court appearance in August 1872.

[I would think that this John DAY is a different person to the John DAY who married Eleanor Caroline JERVIS in 1972. ]

ok thanks for your help Lucy  ;D  I will read up on the rest of the case.  Back to square one on who my John Day was for me

Mind you that first court case was after the date of the 2nd wedding (if his) so he might still have been getting away with it, he cant have been living with 1st wife and he sure wasn't giving them any money.
