I haven't been able to do any research for a few years.  I can no longer search using the LDS site (it just says error 404).  Theophilus was bc1826 Leeds.  He was my g,g,g,grandfather.  I think his father was John, a potter.  I have found Theophilus on the 1841 census living alone, he married Elizabeth Heaton bc1822 (my g,g,g,grandmother) in August 1848, St Mark's, Woodhouse.  Elizabeth died in 1866 and was buried in a churchyard in Armley, she was the daughter of William Heaton.  I am very rusty due to not researching for a few years.  I would like more info or advice to take this line further back.  This is the line that got me hooked, but I haven't been able to expand it.  Any help or advise would be gratefully received.

I have found census records and a further marriage for Theophilus Hayes and also a burial record for Elizabeth Hayes.

St. Bartholmew (Armley)

27th February 1866 burial of Elizabeth Hayes of Armley aged 44 years.

By 1871 Theophilus as remarried and is living in Keighley, West Yorkshire.

15th April 1868
Theophilus Hayes aged 41 Widower  Insurance Agent of New Wortley.  Father John Hayes, Potter
Mary Ann Naylor aged 42 Spinster of Armley.  Father Samuel Naylor, Tailor.
Witnesses William Naylor, Emma Stansfield.

Interestingly on the image of the certificate for his marriage to Elizabeth, the fathers name column was left blank.

Joseph Hayes Son Unmar 21 Machine Fitter born Leeds

Theophilus Hayes Head Mar 55 Insurance Agent born Leeds
Mary Hayes Wife Mar 56 born Leeds

Theophilus appears to have died in Keighley in 1886.

Theophilus Hayes Reg Year 1886 Reg Quarter Jul-Aug-Sep Age at death 59 Reg District Keighley
Volume 9a page 127.

Theophilus is buried in Utley Cemetery and a photograph of his headstone can be viewed on the website www.findagrave.com

Theophilus' criminal record:

Theophilus Hayes, 50,insurance agent, admitted to bail 17th December 1875, tried on 30th March 1876.

Unlawfully and maliciously publishing a certain defamatory libel of and concerning a William Smith at Keighley on 2nd December 1875. He pleaded guilty and was fined £50, to be imprisoned in the Common Gaol in Leeds until the fine was paid and to keep the peace for twelve months.

I have found the burial of a John Hayes in St. Bartholomew (Armley) where Elizabeth was buried.  I will post the details but without a baptism record it is difficult to say for sure that he was Bartholomew's father.

6th December 1857 burial of John Hayes of Armley aged 55 years.

I then found John in the 1851 census.

Elizabeth Hayes Wife Mar 43 born Beeston
Elizabeth Hayes Dau Unmar 19 Book or Boot Binder born Tockwith
John Hayes Son Unmar 12 Scholar born Armley
Ann Hayes Dau Unmar 2 At Home born Armley

Possible Marriage
28th May 1821 St. Peters Church, Leeds
John Hayes of this parish Brazier
Elizabeth Truss of this parish Spinster (I think her surname is Truss.  It is difficult to decipher)

I have posted this information for you to consider but as I say without a baptism record for Theophilus it is difficult to say with any certainty whether this is his father and mother.

I did know that John was on his second marriage certificate but I've not actually seen it.  I don't know why he is omitted on his certificate for his marriage to Elizabeth. 

I knew he had a brush with the law, he was said to have been very political so maybe this was due to this.  Is there any way that I can research this?

I have tried the link for familysearch.org (this is the web address that I used to use) but when I put the details in and click the search it says error 404

Theophilus is listed as Heys in 1841 alone, but I cannot find the Hayes family listed by cjl either in 1841 or after 1851. oh I just found them in 1841 living in Wasp Nest with

John aged 40 Maltster from Yorkshire
Elizabeth aged 35 from Yorkshire
William aged 13 Wool Picker from Yorkshire
Johnathan aged 4 from Yorkshire,

I'm now going to search for Elizabeth the daughter in 1841, not sure why John/Johnathan's age keeps changing. I forgot how much head scratching this caused  ???

I don't live far from Leeds, infact the photo of the grave might be one of mine (I live a few miles from Utley Cemetery).  Unfortunately I am in a wheelchair and cannot get to view the archives in Leeds.  Is there another way that I can search for Theophilus's baptism records?
