Registered Bond Of Provision

My own Jolly research has been stuck in the doldrums for ages however yesterday I had a look at the 1855 valuation rolls and discovered Diana Jolly (nee Rae - wife of the Captain) is listed as the proprietor of a house at Woodston! Woodston is where her husband was born in 1811 now wondering if this was a family home she inherited when her husband died?

After the death of the Captain in 1847 Diana married a George Nicol and there appears to have been something called a 'registered bond of provision' drawn up in 1862. Reading through the will it sounds as if Diana brought a considerable sum to the marriage plus an annuity and on George's death she was to receive £500 although the amounts listed in the will e.g. cash, furniture and personal estate come nowhere near to that figure.

I'm really curious about this 'registered bond of provision' was she guaranteed this amount?

Hopefully someone with knowledge of the Scottish legal system at that time will see this post and add some comments.

Just for now, a Bond of Provision, I thought was to do with bequests for children?

Such as here: a bond in which certain stipulations are made on behalf of, chiefly or only, the children of the party concerned  - www.dsl.ac.uk/entry/dost/provisioune point no.6

Is there simply a reference to it in the will you have read from 1862 (is this a will for George Nicol)?

Hi Monica,
George Nicol died in 1867 and the first part of the document is an inventory with a mention of the Bond - this document was written in Stonehaven shortly after George's death. The second part of the document is an extract of the Bond of Provision it starts - "At Edinburgh, the first day of April 1862 in the presence of the Lords of Council..." it then goes on for three and a half pages - at one point it states "upon my death I should make provision to her and her said children of the sum of five hundred pounds sterling..."

My reading is that everything she possessed passed to George Nicol at the time of their marriage in 1857. However the Bond only mentions the annuity and her 'movable property' so I'm left wondering about the Woodston house?

Monica - just checked 1875 VR - she still had the house! Mrs Nicol - "Woodstone" proprietor ;) Looks like she had the property until her death in 1895. If I knew the history of that house then I might get further back with my Jollys ;D

There is mention in St Cyrus of Woodston www.scotlandsplaces.gov.uk/digital-volumes/ordnance-survey-name-books/place-names/St%20Cyrus?class=parish&county=Kincardineshire

You would need to perhaps check the Register of Sasines to check on historic ownership of the house and lands (?). Not available online unfortunately. Did Diana leave a will?

Unfortunately, no will for Diana...looks like I'll have to check the Register of Sasines - bother! But at least I now know she owned the house which is pretty amazing.

'Lands of Sunnyside" might help further to narrow down location as would the original page from these census to see surrounding properties and land references etc.

51 - St Cyrus - no house names just 'village' for each entry on the page
61 - she's living Inverkeilor with 2nd hubby
71 - St Cyrus - all the houses on the page described as 'Kirktown'
81 - St Cyrus - first house on the page described as 'Village Woodside Croft' then her house just 'Village' then next house 'Village lodging house'
91- St Cyrus - all the houses on the page described as 'Kirktown'
71,81 and 91 her house is described as having three rooms with windows...
