Good Pickup Sue....however......as below it does show David Benn marring Robina Kerr....I think this is what they call a False-Positive...what you see is written, but its not true....appears David is from Yorkshire, couldnt find him as a convict or passenger into Australia, and if a soldier from the UK he couldnt marry Robina as she was not pardoned till 1853 [5 years of a 7 year term] below says married 1851

Have you looked at the marriage document?
The marriage was in 1851
He was a Ticket of Leave man (bachelor)

His surname  was either BYRNE or BURN both of which are sounded identically.

He was illiterate.
When he said his name for the registration it sounded like BENN.

I do not see he came from Yorkshire (or anywhere stated)

The names changes you talk about are not name changes at all, they are the same surname spelt differently.

They were both convicts so needed persmission to marry - David BURNS arrived on the Hydrabad (2) in 1849.

David was tried at Cork and County Cork was also his native place.

Im happy with the research and names I have...all good A lot of good helpful info on that Tassie Convict site.
With small embracement to Sue and her David Benn marriage.. after my lengthy answer, I found a copy of the original marriage certificate of David and Robina 1851...I just do not understand this ..

David was not a convict but marriage record says Robina [convict] Not a land owner/employer only soldiers were not recorded coming and leaving Tasmania, and anyway married 1851 to David and then again 1853 to another David Burns....Burn and Benn   surly we do not have a convict marriage during sentence making the surname look like Burn then later a civil marriage to Burn when free 
open to suggestions here
come along way from just asking if anyone know Robina parents in Dundee...cheers

Phoebe Easter Steward and daughter Fanny Amelie Steward [Easter]...well James Burns never married Phoebe, had 2 kids....has anyone seen this before where the Church people instead of adding Bastard Kid or Illegitimate Kid of James Burns, they added instead Easter which was Phoebes Mums surname

Why do you think that James BURNS was the father of Fanny Amelia EASTER?  You say "church people", I can only see a birth registration for Fanny, not a a baptism, have you seen one?  If Phoebe didn't name a father when the birth was registered then no father's name will be recorded, only the mother.  This perfectly normal where the father is unknown.

Thankyou yes 1406 is our Man...stealing clothes...wow...Kmart probably lose that much clothes every friday...poor ol David got 7 years....
small fact....most convict never went back because they didnt want to...good food here good air good water, meat instead of one a year once a month, this caused the next generations to become taller and healthier

David and Robina applied for, and were granted, permission to marry.  David was a convict.  Where is the marriage in 1853? I can't see one.
