Contested Will
« on: Tuesday 20 September 05 14:00 BST (UK) »
Can someone possibly explain what happens when a will is contested.

I am unclear as to whether or not a will can be contested after probate has been granted.  My father's will (probate granted 23/12/1955) was, to the best of my knowledge, contested later and it took several years to be settled.
I would just like to know if this was feasible, as I have been told that a will can only be contested before probate.

Many thanks
Dave

http://www.dmmclean.co.uk/wills/contested-wills.htm - according to this solicitor's site, 'In situations where a claim can be made it is general practice to wait until probate has been granted and after that time there is a period of six months for any claims to be lodged.'
Census information is Crown Copyright, from www.nationalarchives.gov.uk

Thanks, I read this too, but I've also read elsewhere that there are so many days to make a claim before probate is granted, so I've no idea which is true.
Also, I don't know where to get a copy of the final will.  I tried York Probate Registry and they couldn't help as they would do a search and come up with the same will I have!
